Anyone studying law?

Been asked by a foreigner on this question about British law...

---

Esther has lived in Bleak House all her life, although the property is actually owned by Dedlock. As Esther has protected residence rights in the property, Dedlock can only sell the property subject to Esther’s rights as a sitting tenant, so he proposes to Esther that she buy the house from him at a discount of 25% of its actual value of £200,000. Esther thinks this is an excellent idea and agrees to pay £150,000 but doesn’t have enough savings to complete the purchase herself. She therefore discusses this with her cousin, Ada, and persuades Ada that putting £100,000 towards the purchase of Bleak House would be a good investment for her. Ada has actually been looking for a new base in England (as she spends most of the time out of the country) and decides that it will also suit her to take over a room at Bleak House where she can leave all her clothing and possessions returning to live there between her travels. Esther now only needs to find £50,000 which she obtains in the form of a mortgage from Jarndyce investments enabling her to complete the purchase of the house which is transferred into her sole name. Ada moves her possessions into the house and suggests that they make a few improvements to the property, adding a conservatory and generally renovating and updating the bathrooms and kitchen, this costs £20,000 which Ada duly pays. As soon as the work is done Ada then departs for Africa for an unknown period.

Feeling rather lonely without Ada, Esther is befriended by Richard and invites him to stay temporarily at Bleakhouse until Ada’s return. Unknown to Esther, Richard is a conman who is currently wanted by the police for fraud and so happy to hide away in Bleak House. Richard persuades Esther that he can assist her with the management of the house and the mortgage, thereby saving her money and worry. She accepts his help and, on his suggestion, transfers the property into his name, accepting his oral assurance that this will make it easier for him to effectively manage the property but that Bleakhouse will of course remain hers. In fact Richard then arranges to re-mortgage the property for £150,000 with Chancery Bank, repaying the £50,000 owed to Jarndyce investments. Knowing that they will send a surveyor to check the property, he arranges to send Esther to Paris for a weekend trip and assures the surveyor that the rooms occupied by Esther and Ada belong to friends of his who are currently staying with him for a month. The surveyor accepts this statement and the mortgage monies are paid to Richard.

A month later, Richard disappears with the money, just before the police arrive at Bleakhouse to arrest him. Three months later a representative from Chancery Bank knocks on the door and demands the mortgage arrears from Esther, saying they will repossess the property if they do not receive them. Esther is distraught as she doesn’t have the money and when trying to contact Ada, is told that she has been killed in a car crash in Africa leaving all her estate to her brother Charley.

a)Advise on the legal and equitable rights to Bleakhouse in particular considering the occupation rights and financial claims in particular and how any dispute would be resolved.

b)What difference would it have made to your advice, if any, if Ada had contributed £75,000 to the initial purchase price and Esther had obtained a mortgage in the sum of £75,000.

So, on the rare occasion I go out (babysitters, workload, money allowing) I have my social fix and I think OK, we've had our fun let's get the bus (that's cost us the best part of £12) home. Just before we go to catch it we stop off for food....BIG MISTAKE!!! The driver says he ain't going to take us home with these offensive weapons of mass consumption. Looking at the signs on the bus it says "no eating or drinking on the bus", I accept this and state food is to be re-heated at home and would he like me to leave a deposit to assure that we would not open the containers. He stands by his decision to leave us stranded 15 miles from home, so I resort to protest mode, sit down and ask him to call the police.

Serious, he broke every speed limit on the way home (by the way I won!!!), broke at a risk of throwing people through the front of the cab and forgot the fact that in the depot he munched his way through a late evening bus man's snack (made aware by a passenger from an earlier stop). Anyone else take this lack of public service further? I mean they speed, ignore passengers' request to catch busses and ignore many other traffic laws, take all kinds of shit from the mobile phone warriors yet get all moral about a carton of chips.

Any other stories out there?

Being single

I haven't done this for a very long time (last time we split doesn't count as I knew we'd get back together) and a lot has changed since then. For a start all my mates who were single when I got married are all under the thumb. So what do the singletons amongst us do? I've had enough of not sleeping and crying into my coco pops and I want to 'do' stuff. It all feels very alien to me.
This is also an ideal moment to discuss what you've done after a long term relationship has broken down.
I'm not talking about dating and shit because that is far from my mind right now and besides, I'm still married (for now).

Moving to Cardiff

I'm planning on moving back to South Wales this summer after four years away in Leeds at university. I'm hoping to study a Masters course in Sustainable Energy & Environment at Cardiff University, or alternatively at the Centre for Alternative Technology (http://www.cat.org.uk/) up in Snowdonia but would probably still live in Cardiff three quarters of the time. My first question is, does anyone have any experience of either of these courses, or even the Engineering school at Cardiff Uni in general? If so it'd be really useful to talk to you.
Secondly I'm just looking for general tips/advice on moving to Cardiff, like what sort of rent can you expect to pay in different areas, and what are some pros / cons for each? I know the city center pretty well but only have a rough feel for the differences and proximity to the center of some of the residential areas like Canton, Roath, Cathays, Adamsdown, Splott... What's the best way to find rented accomodation / house shares. I have quite a few friends living in Cardiff and a couple more moving from Porthcawl there the same time as me so we might look together, otherwise I'm gonna need to find some people to live with, maybe other postgrads?
What's the good shit going on in Cardiff these days, any food co-operatives, DIY arts / music collectives, venues, etc. ?

KONY 2012

As with every social media rise up, I'm naturally suspicious and there's definitely a lot of bad stuff going on with this one. Rather than a genuine plea for help from people in a terrible situation, it's PETA tactics once again with slickly edited emotional videos and tons of hypocrisy. The worst part at the moment is Facebook is blocking the link to the blog I'm about to quote, which I'm hoping will be reversed some point soon as it's undoubtedly being complained about.

Anyway, here's some info... link at the bottom which contains the original text and all the inline links for further reading. As with everything on the internet, don't believe anything at first glance and read up further for yourself before committing.

But hey, as it's social media it's 99% of people RTing and posting something on their walls and not actually giving a shit anyway.

Quote

I do not doubt for a second that those involved in KONY 2012 have great intentions, nor do I doubt for a second that Joseph Kony is a very evil man. But despite this, I’m strongly opposed to the KONY 2012 campaign.

KONY 2012 is the product of a group called Invisible Children, a controversial activist group and not-for-profit. They’ve released 11 films, most with an accompanying bracelet colour (KONY 2012 is fittingly red), all of which focus on Joseph Kony. When we buy merch from them, when we link to their video, when we put up posters linking to their website, we support the organization. I don’t think that’s a good thing, and I’m not alone.

Invisible Children has been condemned time and time again. As a registered not-for-profit, its finances are public. Last year, the organization spent $8,676,614. Only 32% went to direct services (page 6), with much of the rest going to staff salaries, travel and transport, and film production. This is far from ideal, and Charity Navigator rates their accountability 2/4 stars because they haven’t had their finances externally audited. But it goes way deeper than that.

The group is in favour of direct military intervention, and their money funds the Ugandan government’s army and various other military forces. Here’s a photo of the founders of Invisible Children posing with weapons and personnel of the Sudan People’s Liberation Army. Both the Ugandan army and Sudan People’s Liberation Army are riddled with accusations of rape and looting, but Invisible Children defends them, arguing that the Ugandan army is “better equipped than that of any of the other affected countries”, although Kony is no longer active in Uganda and hasn’t been since 2006 by their own admission.

Still, the bulk of Invisible Children’s spending isn’t on funding African militias, but on awareness and filmmaking. Which can be great, except that Foreign Affairs has claimed that Invisible Children (among others) “manipulates facts for strategic purposes, exaggerating the scale of LRA abductions and murders and emphasizing the LRA’s use of innocent children as soldiers, and portraying Kony — a brutal man, to be sure — as uniquely awful, a Kurtz-like embodiment of evil.” He’s certainly evil, but exaggeration and manipulation to capture the public eye is unproductive, unprofessional and dishonest.

As Christ Blattman, a political scientist at Yale, writes on the topic of IC’s programming, “There’s also something inherently misleading, naive, maybe even dangerous, about the idea of rescuing children or saving of Africa. […] It hints uncomfortably of the White Man’s Burden. Worse, sometimes it does more than hint. The savior attitude is pervasive in advocacy, and it inevitably shapes programming. Usually misconceived programming.”

Still, Kony’s a bad guy, and he’s been around a while. Which is why the US has been involved in stopping him for years. U.S. Africa Command (AFRICOM) has sent multiple missions to capture or kill Kony over the years. And they’ve failed time and time again, each provoking a ferocious response and increased retaliative slaughter. The issue with taking out a man who uses a child army is that his bodyguards are children. Any effort to capture or kill him will almost certainly result in many children’s deaths, an impact that needs to be minimized as much as possible. Each attempt brings more retaliation. And yet Invisible Children supports military intervention. Kony has been involved in peace talks in the past, which have fallen through. But Invisible Children is now focusing on military intervention.

Military intervention may or may not be the right idea, but people supporting KONY 2012 probably don’t realize they’re supporting the Ugandan military who are themselves raping and looting away. If people know this and still support Invisible Children because they feel it’s the best solution based on their knowledge and research, I have no issue with that. But I don’t think most people are in that position, and that’s a problem.

Is awareness good? Yes. But these problems are highly complex, not one-dimensional and, frankly, aren’t of the nature that can be solved by postering, film-making and changing your Facebook profile picture, as hard as that is to swallow. Giving your money and public support to Invisible Children so they can spend it on supporting ill-advised violent intervention and movie #12 isn’t helping. Do I have a better answer? No, I don’t, but that doesn’t mean that you should support KONY 2012 just because it’s something. Something isn’t always better than nothing. Sometimes it’s worse.

If you want to write to your Member of Parliament or your Senator or the President or the Prime Minister, by all means, go ahead. If you want to post about Joseph Kony’s crimes on Facebook, go ahead. But let’s keep it about Joseph Kony, not KONY 2012.
Just as everybody was toasting or purchasing in WalMart, Black Adolph signed the law, and one can assume the Brit Royals will use the London Olimpics to foster the same agenda.

The Great Ticket Scandal

I was originally going to post this in the TV Forum, but feel it warrants posting here.

Did anyone else catch Dispatches last night?

We all knew that promoters and ticket agencies were complicit in the selling of tickets to touts via secondary ticket markets, but this reveals a whole new level of cuntishness.

Essentially, Live Nation and SJM (and others) are allocating thousands of tickets directly to Viagogo to sell at inflated prices. The promoters then keep up to 90% of the mark-up price.

So an event sells out, but thousands of tickets are immediately on sale on Viagogo at artificially inflated prices. The 'touts' are actually the promoters and Viagogo themselves.

The programme explains it better than I can, but it's not on 4OD yet.

Apple finally admits to human right violations

Whilst the hipsters are cranking one out over their next over-priced aesthetically pleasing Apple branded gadget, and Apple themselves sit on a reported $100 billion off-shore cash mountain there are people working under slave labour conditions making them.

Thousands of Chinese factory workers will be given the chance to detail the punishing conditions on assembly lines producing Apple iPads and iPhones, after the US company bowed to criticism and agreed to allow independent inspections of its supply chain.

Facing a growing scandal over the working conditions of those making its best-selling gadgets, Apple has called in assessors from the same organisation that was set up to stamp out sweatshops in the clothing industry more than a decade ago. The move is an admission that Apple's own system of monitoring suppliers has failed to stamp out abuses, and that the negative publicity surrounding its Chinese operations threatens to cause a consumer backlash against its products.

But campaigners for Chinese workers immediately criticised the company for conducting a public relations exercise instead of actually alleviating the long hours, harsh management and safety problems which have driven some workers to suicide and led to fatal accidents at a number of plants.

Inspectors from the Fair Labour Association started work yesterday at the Foxconn factory near the booming southern city of Shenzhen, where iPads are made. In 2010, a spate of 13 suicides or attempted suicides at that factory, known as Foxconn City, first turned a spotlight on the companies Apple uses to build its devices. Another Foxconn factory in Chengdu will also be inspected, Apple said, with the first findings to be published by the FLA next month. Apple said all of its suppliers had agreed to co-operate with the FLA and to let their workers speak freely.

Apple has come under fire for building a consumer electronics powerhouse on the backs of exploited workers, many of whom earn as little as 30p an hour. Employees of some suppliers complain of 10-hour shifts with only one permitted break, and of being forced to stand for so long that their legs swell. Last year, there were two fatal explosions at plants producing Apple goods, including one caused by the ignition of dust released by the polishing of new iPads.

The FLA will ask employees about working and living conditions, including health and safety, pay and hours. Its team will inspect manufacturing areas, dormitories and other facilities.

"We believe workers everywhere have the right to a safe and fair work environment, which is why we have asked the FLA to independently assess the performance of our largest suppliers," said Apple's chief executive, Tim Cook. "The inspections now under way are unprecedented in the electronics industry."

Apple's decision to call in the FLA comes after a new round of exposés of conditions at its suppliers. Last week, the campaign group China Labour Watch wrote an open letter to Mr Cook demanding that Apple accept lower profits so suppliers can raise wages, employ more staff and invest in improving safety.

Yesterday, the organisation dismissed Apple's commitment to independent inspections as a publicity stunt. "We already know what the conditions are like in the factories," said Fan Yuan, a China Labour Watch activist. "What Apple needs to do right now is take action to solve the problems. This move is not really about solving the problems, but rather about Apple getting publicity and rebuilding its positive image."

The FLA was set up in 1998 to monitor a code of practice introduced by clothing manufacturers that aimed to stamp out sweatshop conditions among their suppliers, following a similar public outcry and the success of consumer boycotts of offending companies.

Its work comes in addition to the audits conducted every year by Apple itself, which introduced a code of practice limiting the length of workers' shifts and demanded proper overtime pay. The company's spot-checks, though, reveal scores of violations at most suppliers.

Mr Cook, who took over the leadership of Apple last year from the late Steve Jobs, is fêted as the architect of its lean and flexible supply chain, which has been central to its ability to turn devices from concept to mass production in a matter of months. He has also focused on getting products produced at the lowest possible costs, which is one of the reasons that Apple's profits are among the fattest in the technology industry.

Yesterday, Apple's share price passed $500 for the first time in its history, just seven months after it first topped $400. The company is now the most valuable in the world, at $460bn.

Apple in China: The allegations

In July 2009, a Foxconn employee fell from an apartment building after losing an iPhone prototype. Over the next two years, at least 18 more of the company's workers have attempted suicide or have fallen from buildings in ways that suggested suicide.

In 2010, 137 workers at the Suzhou facility owned by Apple suppliers Wintek were injured after being ordered to use a poisonous chemical, n-hexane, to clean iPhone screens because it dried faster. Although Apple claims to have contacted all the employees affected, many say they have heard nothing.

In May 2011, four employees were killed and 18 were injured in a dust explosion at a Foxconn factory in Chengdu, which produces iPad parts. Chinese campaigners claim they warned Apple of hazardous conditions at the plant.

In December 2011, another 61 workers were injured in a gas explosion at the Riteng Computer Accessory Co factory in Shanghai, which was trialling aluminium iPad 2 back panels.

Employees allege that many of Foxconn's dormitories, where 70,000 workers live, are overcrowded, with reports of 20 workers being housed in a three-room apartment.

So yeah, just thought this was a bit of an interesting story, part of me sees the appeal in living in the woods, personally i'd nick a saw, hammer and some nails or something and try and build a log cabin or a yurt or something. I reckon you could disappear into dians powys woods pretty effectively

End the Big 6 Energy Fix

http://action.compassonline.org.uk/page/s/end-the-big-six-energy-fix

Campaign statement

There is growing public concern about the behaviour of domestic energy suppliers - we believe it is time to end the big six energy fix.

In recent months energy companies have once again been exposed for over charging customers and making excessive profits at the expense of ordinary people, this is even more unfair at a time when the incomes of those on lower and middle incomes are being squeezed. Energy is an essential human need – we all require affordable energy to light and heat our homes and to run our businesses – yet for many the stark reality is that energy is increasingly unaffordable.

For the first half of 2011 alone the big six energy companies made almost £3.5BN in profit. At the same time OFGEM revealed in October 2011 that the big six energy companies had increased their profit margins for dual-fuel deals by a staggering 733% (from £15 to £125 per household) with OFGEM’s CEO conceding that ‘we do not have a fully competitive energy market’.

Indeed the average annual household bill for gas and electric has risen from approximately £500 in 2006, to over £1200 in 2011, whilst USwitch has predicted that by 2020 this could rise to a massive £3202.

Furthermore, it is estimated that at least 5.5M households are living in fuel poverty, with another 400,000 forced into fuel poverty with every 10% price hike.

So firstly, given this context, we believe now is the time for the Government to respond to the excessive profiteering of the big six energy companies by imposing a similar levy to that imposed on the oil companies.

Let’s not forget that windfall taxation was used by the Conservative Government in 1981 to claw back the excessive profits of the High Street Banks, in 1997 by the Labour Government on the privatised utilities and the levy imposed by this Government on the big banks. The Government has also responded to the excessive profits of North Sea oil companies by levying a permanent windfall tax - which has funded a reduction in fuel duty.

Revenues from any levy should be ring-fenced. Part of the money raised should be used to offer immediate help to those living in fuel poverty. However the best strategy to eliminate fuel poverty forever is to ensure every home is insulated and highly energy efficient. Therefore much of the money raised should be used to provide additional investment for home energy efficiency measures - starting with the homes of the fuel poor. Such a Green New Deal would have the benefit of providing jobs for thousands currently out of work.

Secondly, to prevent the energy companies passing the cost of any levy onto customers and to make energy prices fairer, we further call on the Government to provide the regulator with new powers to cap prices, this could be linked to the wholesale price so that energy companies can still make a reasonable profit to guarantee future investment, yet eliminate excessive profit at the expense of people and planet.

Finally we call on the Government to launch an independent public inquiry into the big six energy companies so that OFGEM, the Government and the public know what measures are needed to have a market that serves people before its serves profit.

The time has come to end the big six energy fix – we urge the Government to act.
While the second story isn't particularly pleasant the fact the state is willing to punish people for handing out hateful leaflets is definitely something to be proud of as a society.

Little things that make you grateful for your lot in life

I'm a bit of a grouch and 10 years in I.T getting fucked over by employers coupled with a crippling mortgage has made me grumpier than ever these days. However............I do realise how good I've got it compared with some.

So lets hear it for those little things that happen right in front of your face when you're having a bad day that make you take an immediate reappraisal of your life and think "It could be worse, I could be that guy".

I'll start: I was driving to work about a month ago in a particularly shitty mood due to some shit that has gone down in the office that I'm stuck right in the middle of. I turned right out of my street to see two blokes in high vis vests working down a hole to fix some kind of burst pipe. There was a young slim bloke in his 20s and a stocky, chubby 40 year old. At the exact moment that I looked over at them the older bloke lost his footing on the pavement and slipped into the hole, which was brimming with water. He obviously pranged his knees or ankle on the way down as he sort of flopped forwards and the young guy tried to grab him and stabilise him, and he then lifted one hand to say 'I'm alright'. It was 8.30am on a really cold miserable January day and I felt for the poor sod as he probably would have had to carry on working in his sodden clothes in the freezing weather all day.

It made me a little bit more grateful about being in my nice warm dry car heading to my nice warm dry office.

SWM 10th Anniversary Gig Needs Your Help

Yes, as mentioned in a few other threads... SWM hit's it's decade anniversary this year. It felt only appropriate to do a proper celebration as that's silly long for a site catered to niche music in a specific locality. I'm not even sure what niche we appeal to now.

Rather than half arsing something, I think it'd be really good to put on something memorable as it's unlikely to hit 20 years, realistically.

So mid-October or early November I'd like to book an affordable venue out for the weekend, and put on as many bands that either got started from here or are made up of members here, friends of ours (Conan and the like) and anyone remotely relevant. It's been a while since we had a group effort thing here and they were always some of the best shows. I've noticed once a year or so there always seems to be a gig that everyone is at, sometimes through fluke or a Douglas reunion or similar.

So anyone up for helping out, post post post. Anything I do myself show wise is hit/miss so the aim is to try <del class='bbc'>rope</del> get as many of you guys as possible to help. There's some great artists on here so any chance of getting an awesome poster would be wicked, promoters with far better organisational skills than me and loads of people to spread the word and help out in any other way.

It'd be great to set a stupidly low ticket price on this and get a ton of people through the doors for a load of good bands. Venue hire will be an expense but fingers crossed I can get a good price somewhere and that'll be the worst done.

I've found a few threads that talk about stuff SWM has either done or personal memories that are worth a read. I'm not sure how much money raised for charity totalled, but it must've been around £20,000 which is pretty rad. I miss our community efforts, hope some of you feel the same way!

'How Long Has SWM Been Going?' - http://www.southwalesmassive.com/index.php?showtopic=78171&st=40
'Bands (and other things) that wouldn't have happened without SWM' - http://www.southwalesmassive.com/index.php?showtopic=67534&st=0

The band one is a few years old too so a ton of other bands have popped up since, and it's cool to see how the user base has changed over time with regards to tastes (and temperaments!). Feel free to post new-nostalgia here too then!

Newport Bouncers - New channel 4 series

I cannot fucking wait.. some utter howlers on the trailer below. On at 10pm on Channel 4 tomorrow.. imagine there'll be a few old faces on there from in / around Newport.

Anyone know when they were filming this? Sam?

http://www.channel4.com/programmes/bouncers/video/series-1/episode-1/bouncers

In a weird way I kind of hope it brings more people into Newport if only out of morbid curiosity as it certainly needs some boost in terms of getting new people into the City. Maybe in a warped way this will be it? ha ha
